How to Acquire and Register a Land in Ghana

Acquiring lands in Ghana is something that involves a lot. Without experience, therefore, one is likely to get into several problems. Many people who have bought lands without any experience have either lost it or have had to fight for it in court.  Since we would always need lands for agricultural or building or leasing purposes, it is necessary to find out the right way of acquiring and registering lands in Ghana.

Before we delve into the process and procedures for purchasing land in Ghana, let us update ourselves with the various forms of interest that exist over land and persons they are vested in.

Land Ownership in Ghana

    1. STOOL/ SKIN LANDS: These are lands under the custodianship of various chiefs
    2. INDIVIDUAL/PRIVATE LANDS: These are lands owned by individuals and private entities.
    3. FAMILY LANDS: These are lands managed by Heads of families assisted by principal members of the families.
    4. STATE AND STOOL VESTED LANDS: These are lands managed by the Lands Commission

Types of Interest in Land

A Legal interest in a land refers to the legally enforceable right to possess or use property.  When acquiring a land, it is necessary to find out the period within which you can use it to avoid future problems. These are some types of land interests:

The Allodial Title

The allodial title is the highest title in land recognized by law. Only traditional leaders, families or the Ghanaian government can hold such a title. It has an absolute interest meaning it does not expire.

Freehold Title

There are two forms of freehold title interest:

  • Customary freehold: This is an interest that individuals or groups hold in a land, which is owned by a larger traditional community – the allodial owner –  of which the interest holders are members or subjects. It is an interest that is transferrable to successors of the individual or subgroups until there are no successors.
  • Common law freehold – Common law freehold is similar to the customary freehold. The difference, however, is that this interest can be acquired by both strangers and members of the community that owns the land. A stranger in this regard refers to a Ghanaian who is not a member of the land-owning community. It is important to note that the 1992 Constitution by article 267 (5) forbids the creation of freehold interests in stool land in Ghana.

Leasehold

A leasehold/lease is an interest in land that has a specified start and end for a period, subject to payment of annual ground rents and covenants. It usually expires from 50 to 99 years.

Tenancy

They are created under contractual, share-cropping or other customary tenancy arrangements. Two very common tenancies in the Akan areas are “Abunu” where the land is acquired from the owner and “Abusa” or “do ma yenkye”, where farm proceeds are divided into two- thirds between the farmer and the landowner. Other areas have different names for these arrangements in the local dialects.

Licensing

Someone may acquire a land but not acquire it absolutely. A licence to operate is usually given to him/her temporally. These include lands near highways etc. Since we know there would be future developments in such areas, those lands are not sold absolutely, a license is given out for temporal use. This means that one does not have to put up a well-structured building on it. They usually last for three or five years.

Acquisition of Land

To acquire the land, it would be necessary to determine what you are going to use the land for be it for residential or commercial properties or agricultural purposes or recreational purposes. This would help determine the kind of land to acquire. You can acquire land through the following:

CHIEFS: This is predominant in the Ashanti Region. You acquire the land from the chief and he gives you an acquisition note and the site plan (Plan of the land you are acquiring.)

INDIVIDUALS: Here, you acquire the land from a private individual who may have acquired the land from someone else or from a chief. One must be very careful when purchasing from individuals. It would be necessary to research on the land to see if it really belongs to the person. Also, you need to know if it has not been sold to anyone else or if the land has not been taped for future national projects. Again, let the seller provide certified site plan demarcating the precise location of the land including its coordinates. It is necessary not to exchange money until you are assured of the land and have negotiated sales term.

FAMILY HEADS: Here, you acquire the land from a family head.

COURT: Here, you acquire the land from the court through auctions.

 

Registration of Land (How to Register a Land in Ghana)

STOOL/ SKIN LANDS-Registration procedures

  1. Applicant/developer negotiates with the chief concerned for the land.
  2. Three copies of the document executed between the chief and the applicant to be submitted to Lands commission
  3. A solicitor of the supreme court (i.e. a practising lawyer) must sign the back of each copy with his stamp duly affixed.
  4. Each copy of the document must have a site plan attached. Two extra site plans, making five (5) in all must accompany the documents.
  5. The back of the site plans are to be endorsed by both the chief (lessor)/seller and the applicant (lessee)/buyer.
  6. Each site plan is to be certified by the stamps of a licensed surveyor and the Regional surveyor and duly dated.
  7. At least two principal Elders of the stool (with status) must sign as witnesses.
  8. The witnesses of the applicant (lessee)/buyer must write full names, provide addresses and signature.
  9. Documents must be submitted to lands commission.
  10. Processing and registration fees should be paid.
  11. Chairman of Lands commission grants concurrence.
  12. Documents are released for stamping at land valuation Board.
  13. Applicant obtains a Tax Clearance Certificate at Internal Revenue Service.
  14. The document is registered at Deeds Registry at Lands commission.
  15. The applicant pays first year’s ground rent
  16. Original copy of the document is released to the applicant.

 

INDIVIDUAL / PRIVATE LANDS-Registration procedures

  1. Applicant/developer negotiates with the actual owner concerned for the land.
  2. Three copies of the document executed between the actual owner and the applicant to be submitted to Lands commission
  3. A solicitor of the supreme court (i.e. a practising lawyer) must sign the back of each copy with his stamp duly affixed.
  4. Each copy of the document must have a site plan attached. Two extra site plans, making five (5) in all must accompany the documents.
  5. The back of the site plans are to be endorsed by both the actual owner (lessor) /seller and the applicant (lessee)/buyer.
  6. Each site plan is to be certified by the stamps of a licensed surveyor and the Regional surveyor and duly dated.
  7. At least two principal Elders of the stool (with status) must sign as witnesses.

Property valuation is at the core of the property selling process. It is important for everyone involved in the buying and selling of property to know how much the property being sold is worth from the very start. This is to help you negotiate a fair asking price and for the buyer to grasp the current state of the local market.

What is Property Valuation?

Property Valuation or appraisal is the process of determining the worth of a property whether land, buildings or other properties.

A person may need property valuation if they want to sell or purchase a property or rent or let out a property. Property Valuation is also important to secure a loan or for taxation purposes.

Estimating the worth of a property requires the experience and expertise of a valuer. A valuer is a professional whose job is to determine and say how much a property is worth.

 

Processes Involved In Property Valuation

We will look at an instance where an investor is seeking to sell his house.

Looking for a professional Valuer

Before the asking price is fixed, the owner would look for a professional valuer to determine the market value of his house and present the documents of the property to him.

Inspection of Property

The valuer will visit the house and conduct an external and internal inspection, taking pictures and even asking the owner questions about the property. The valuer will evaluate the land component of the property, which can make up a significant proportion of the property’s total value.

The valuer will also assess the size, shape, aspect, and topography of the land as well as the zoning and development potential. Inside the property, the valuer will measure the size of the building and take note of the number and type of rooms, the property’s age and condition, its fixtures and fittings, its design and layout, and any unique characteristics that could affect the value.

Interestingly, valuers look at many of the same things that a prospective home buyer would look for when assessing a potential purchase. The reason is that overall home buyers make up the majority of the market for real estate and therefore play a major role in determining “market value”.

Determine the value of the property

The Valuer would also compare the property with other properties in the neighborhood that has been sold currently. He would then use his expertise to determine the value of the house.

 

Factors that are Consider In Property Valuations

  1. Location of the building: First, the value of your building is based on where it is located. Different neighborhoods affects the value of a building. The neighborhood’s value is based on multiple factors including its crime rate, how close it is to schools, shopping centres, and access or transportation to and from the home. Also, comparable prices of homes up for sale or recently sold in the area is also considered. Values of houses in urban areas can go down based on vacant lots or condemned properties in the vicinity, and pricing in rural areas can decline depending on road access and land use nearby. The location of your building, therefore, goes a long to affect the value of your property.
  2. Structural Construction Materials and Updates: Construction materials used to build the foundation of your home is considered as important in appraising your home. A house built recently with modern materials, or updated to use modern materials will hold a higher value than a home that hasn’t been updated since it was originally built decades ago. Changing or updating other materials like the roof, windows will also add to your home appraisal value because they improve the overall efficiency and safety of the structure of the home.
  3. Age of the Home: How long your building has lasted will also be a factor in its appraisal value. This does not mean that a newer home, for instance, would always have a higher value than an older one. However, new homes that were built within the last 10 to 20 years are less likely to have major issues, so there’s lower risk in buying them. This will, therefore, increase the home appraisal value. Older homes that are located in historic districts or have been maintained very well for decades will also have a high appraisal. This means that new buildings that are poorly built and show signs of weakness would have a low value. An old building too that has not been properly taken care of would also have a low value.
  4. Number of Bedrooms: The number of bedrooms in your home has will also increase your home appraisal value. The home appraiser will compare your home to other homes in the area with the same number of bedrooms to make a value comparison.
  5. Recent Home Renovations: If the home has undergone large home renovations since the last time it was appraised, this will also contribute to the home appraisal value. Newly updated kitchens and bathrooms hold a lot of value in today’s market, so an appraiser will take these renovations into consideration when determining the value of your home. Before putting your home on the market, choosing high impact areas of your home to renovate could have large returns on the appraisal value of your home.
  6. The Current Real Estate Market: Finally, the current real estate market has a large influence on how your home is appraised. Homes appraised during a time where there’s a market that’s saturated with many buyers and not enough inventory to accommodate all of them will be appraised higher. On the other hand, your home appraisal value during a market that’s saturated with many homes and little buyers will be appraised lower.

With such knowledge, you can readily improve your old building or work on future buildings in such a way as to increase its value according to the state of the local market.

There are so many disadvantages of using unprofessional agents. Not only do they act unprofessionally, but their actions go to the extent of causing you to lose money, purchase a house that’s not of your interest, get a building in an unfavourable neighbourhood or get you a home that many issues with both exterior and interior conditions.

Using Experts Against You

Whiles professional agents can use connections with experts in the Real Estate or other fields in your favour, unprofessional agents are likely to use them against you.

For instance, instead of a fair report from a home inspector, an unprofessional agent can use their connection to lure the inspector to give a wrong report of the house. For instance, there may be problems with the wiring of the building you want to purchase which may cause future problems but an unprofessional agent may get the home inspector to ignore it and make you buy the house for his personal gains.

Extortion

An unprofessional agent is likely to manipulate you to either buy or sell your property at a price that would favour him. They are likely to extort you because you do not have direct access to the buyer or seller.

For instance, if your selling agent is unprofessional, he can price your property so high so that he can have his own share after selling the property aside his commission. In that case, it could take a very long time to sell your property as many buyers would be unwilling to buy. An unprofessional buying agent can also manipulate you to buy a house at a fairly higher price for selfish reasons causing you to lose money.

Dishonesty

Put Your Brains to Good Use!

They say we should advocate for “Internet for Education”, they are not wrong. We are living in a generation where technology has become a very essential tool to a better life, albeit its cons. “Everything” you need now can be found on the Internet.
I’m not against that at all.
But come to think of it, if we have everything done for us, what will our brains be use for then, playing video games? Well, that’s another uses of technology too.
SHS students as well as JHS and Basic school students are advocating for the use of internet, which is quite laudable. Except for the fact that they want to use mobile phones and ipads for studies, whiles the computer labs serve as white elephants. I find this quite preposterous!
I mean, we were never allowed to use calculators until SHS, and even then we wrote articles and essays straight from our heads. References were only available in books and news papers. And the generations before us did not have the privilege to enjoy that either, yet they excelled, even better than we did, and certainly better than this so called “computer babies” generation. 1+1 and they are searching for calculators.
Very funny.
As much as these new delopments have been of a tremendous help, it is also destroying our brains. There is so much information available for this generation. By scribbling in a few words in your search engines, you get a tail of options for you to choose from. No, you don’t even have to spell the words correctly, GOOGLE will do that for you too, so you don’t actually have to use your brains at all. It is so true when the Bible writer said “there is nothing new under the sun”. All we do now is “copy and paste”, with few changes to the wording and references, then we call it “our work”!
This is not an apologia, but a plea to individual conscience. If your brains still work for you, feed it with some good food. Read books, write articles, poems, essays, or anything. Even if nobody reads it, read it to yourself.
Rather than spending the whole night watching seasonal movies, read the stories about them, it is as good as watching them and you even get to kill several birds with one stone. Fun huh?

WHAT A PhD IS AND WHAT IT IS NOT

After having completed a PhD degree myself, and having supervised, co-supervised and examined a number of PhD students over the years, I would like to offer some humble advice and pointers to those aspiring to pursue a PhD degree themselves. I find that many Malaysians misunderstood the purpose of getting a PhD degree and the commitments and sacrifices that it calls for.

A PhD is the highest academic and research degree from a university. I have seen both remarkable successes and disappointing failures amongst students pursuing this academic accolade. It takes more than just brain power to complete a PhD.

A degree by research is very different from a degree by coursework. A course degree whether at the undergraduate or masters level is heavily structured. A student just have to be disciplined and rigorous in following this predetermined structure regimentally, without much creativity required from him or her. Of course, creativity is demanded from the student in completing assignments and projects but the demand is nothing close to what is required for a PhD degree.

The most important prerequisites for pursuing a successful PhD program are passion, inquisitiveness, creativity, discipline, persistence, perseverance and meticulousness (or attention to detail). I did not mention intelligence not because it is not important, but because it is less important than the other attributes I mentioned. At least, it is in my book. Others may feel differently. Of those many attributes, I consider passion the most important. Some students start out enthusiastically but loses steam halfway through or towards the end. They lack passion or the love of knowledge. Ever heard of the saying, “when the going gets tough, the tough gets going?” Success in a PhD is simply that. The harder it becomes, the harder you will strive. Sometimes, you do not see the light at the end of the tunnel but you still keep looking for it because you know it is there. When you love what you do, failure is not an option.

Some people do PhD for the wrong reasons. Some take up postgraduate because they could not secure a job after their first or second degree. Some do it because the jobs they have taken up require them to acquire a PhD, for e.g. an academic or a research post. These cannot be the sole reason for pursuing a PhD. You cannot force yourself to do a PhD. You must want to do it badly enough. You cannot force yourself to love something; you must love or want something bad enough to force yourself to get it.

The PhD is an academic journey. There will be failures but mainly successes along your way. You may encounter some foes but mainly friends in the same boat as yourself. It always helps to be in a group of students to share both your setbacks and achievements. Working alone in a silo is the worst you can do to yourself. There are certain things you want to discuss with your fellow students that you cannot discuss with your supervisor; matters that are either academic or personal.

Your supervisor is your mentor, guide and consultant, not your teacher. He cannot teach you your PhD knowledge, you have to teach yourself through his guidance and wisdom. He is more your friend than he is your master. He does not dictate to you what you must do, he merely points you in the right direction. At the end of your PhD journey, you would have been more knowledgeable on the subject of your research than your supervisor. I have heard of students not being able to complete their PhD because they could not get along or see eye to eye with their supervisor. This is the worst scenario that can happen to you. If you do not have a supervisor you can work with, you will not get your PhD no matter how good you are or how hard you work. So, choose your supervisor well, not just the university you want to do your PhD in. Just a few months back, I met a doctoral graduate who told me that to be supervised by this one professor carries more prestige among his peers in the working world.

A PhD degree needs sacrifices, especially when you are a family person; a wife, mother, husband or dad. Family is always important and should always be your priority. However, you and your family members must be willing to make sacrifices that are necessary. There can be no gain without pain. That is why when you finally get your PhD degree, your family members can even be happier and more proud of you than you yourself, because it is as much their accomplishment as it is yours. Their sacrifices must be duly appreciated.

So what does it mean when you have a Dr. before your name? Does it mean that you are an expert on a certain subject matter? Hardly so, I think. It means that you are both a seeker as well as a generator of knowledge. It means that you have enriched the world and added on to the vast body of knowledge through your PhD contribution. The world has become a slightly better place from the knowledge that you have contributed through your PhD thesis and publications. The world now knows more on a subject than before you completed your PhD. Your work get referred and cited by other researchers in your field, as they absorb your new knowledge to generate new knowledge of their own.

Your PhD is an end that should be justified by its means. The research methodology, the analysis and the interpretation should justify the conclusion. The new knowledge must have been tested and challenged by your peers and rigorously defended by you. It is an accomplishment unequal by any other feat. Once you have obtained a well-deserved PhD degree, you become your own teacher as self-teaching becomes common practice. You are always curious and tends to read a lot, not just on your subject matter but on everything. You will find doing new things, exploring new frontiers and taking up new challenges more scintillating. In other words, it will change your life and your outlooks forever.

I hope I have inspired some of you to pursue a PhD degree if what you read here is what you really want from a PhD. On the other hand, I hope I have also discouraged others who have a misconception of what a PhD degree entails, so that you will not go down the road of failure. A PhD is not for everyone.
